01Rule

Inspect before you sign, not after

Signing the handover acceptance form is treated as accepting the property in its current condition. Once signed, your legal position to demand rectification weakens significantly. The correct order: complete the inspection, submit the snagging report, get confirmation that rectification is scheduled, then sign. If the developer insists you sign first to collect the keys, do not sign a clean acceptance. Attach your snag list to the form or add a written note that acceptance is subject to the listed items being fixed.

02Rule

Your developer cannot legally ban your independent inspector

This is the most-asked snagging question in Dubai. The answer: unless your sale and purchase agreement specifically restricts third-party attendees, you have the right to bring an independent engineer. Developers sometimes send generic emails saying external parties are not permitted. In practice this has no contractual basis if it is not written into your SPA and is widely not enforced.

The POA workaround: If a developer cites a SPA clause to restrict access, the solution is a UAE-attested limited power of attorney granting your inspector authority as your authorised representative. 03Rule

Book the day you receive the notification, not the day before

Most Dubai developers give 7 to 30 days between the handover notification and your appointment. Many buyers wait until the final days. The right approach: book the inspection the day the notification arrives. You need the inspection done, the report submitted, and rectification begun before your handover appointment , not a report sitting in your inbox when you walk in to collect the keys.

Note: many developer SPAs require final payment when the unit is deemed “completed” , which is contractually earlier than the actual handover appointment. Payment timing and snagging timing are different matters. Read your SPA carefully on both points.

Know which defects to refuse handover for , and which can wait

Not every snag justifies refusing the keys. Structural faults, active waterproofing failures, HVAC leaks, dead electrical sockets, and any open MEP pipework must be fixed before you accept. Loose fittings, minor cosmetic scratches, and small grout touch-ups can be documented and accepted with written confirmation on the snag list. The distinction matters: refusing handover for a paint mark creates friction without legal benefit. Accepting handover with an undocumented plumbing leak creates a repair cost that was never yours to carry.
