What is the typical defect liability period for new properties in Dubai?

When does my DLP expire and how do I calculate it?
Your non-structural DLP clock starts from the handover acceptance date written in your sale and purchase agreement. If you signed and accepted handover in April 2025, your 12-month non-structural DLP expires in April 2026. Locate that date in your SPA now. If you are within the final three months of that window, book a DLP inspection immediately. There is no extension once it closes.
Why does the developer actually fix DLP items , is it just goodwill?
No. Dubai’s escrow rules typically require developers to hold back a portion of the contractor’s payment , commonly 5% of the contract value , until 12 months after handover as a maintenance and defect guarantee. That retained amount is why a developer has a direct financial reason to close out your DLP claims rather than ignore them. If a developer’s customer care team is slow to respond, the existence of that retention is the most effective pressure point. This is also why the window matters: once your 12 months expire, the retention is released and the financial incentive disappears.

These are two completely different legal instruments and confusing them wastes the DLP clock.

RERA can act on the escrow retention funds , the 5% held back until 12 months post-handover , which gives them real influence over developer behaviour. Straightforward DLP defect complaints are typically resolved within 30 to 60 days. If that fails, the Rental Disputes Centre and then Dubai Courts provide binding remedies with your photographic report as primary evidence.
What if my DLP has already expired?
The 12-month non-structural DLP for MEP systems, finishes, and installations expires at month 12. Once it closes, developer obligation for non-structural items ends. However, your 10-year structural warranty under Article 880 of Federal Law No. 5 of 1985 remains fully in force for defects that threaten building stability , load-bearing cracks, foundation issues, structural water ingress. This liability cannot be waived and runs for 10 years from the building completion certificate.
